II. The rights of users and data subjects

With regard to the data processing to be described in more detail below, users and data subjects have the right

  • to confirmation of whether data concerning them is being processed, information about the data being processed, further information about the nature of the data processing, and copies of the data (cf. also Art. 15 GDPR);
  • to correct or complete incorrect or incomplete data (cf. also Art. 16 GDPR);
  • to the immediate deletion of data concerning them (cf. also Art. 17 DSGVO), or, alternatively, if further processing is necessary as stipulated in Art. 17 Para. 3 GDPR, to restrict said processing per Art. 18 GDPR;
  • to receive copies of the data concerning them and/or provided by them and to have the same transmitted to other providers/controllers (cf. also Art. 20 GDPR);
  • to file complaints with the supervisory authority if they believe that data concerning them is being processed by the controller in breach of data protection provisions (see also Art. 77 GDPR).

In addition, the controller is obliged to inform all recipients to whom it discloses data of any such corrections, deletions, or restrictions placed on processing the same per Art. 16, 17 Para. 1, 18 GDPR. However, this obligation does not apply if such notification is impossible or involves a disproportionate effort. Nevertheless, users have a right to information about these recipients.

Likewise, under Art. 21 GDPR, users and data subjects have the right to object to the controller’s future processing of their data pursuant to Art. 6 Para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.

You may revoke your prior consent to the processing of your personal data at any time under Art. 7 Para. 3 GDPR with future effect. All you have to do is inform us that you are revoking your consent.

We offer you the opportunity to post questions, answers, opinions, and ratings on our website, hereinafter referred to jointly as “posts.” If you make use of this opportunity, we will process and publish your post, the date and time you submitted it.

In addition, we will also process your IP address and email address. The IP address is processed because we might have a legitimate interest in taking or supporting further action if your post infringes the rights of third parties and/or is otherwise unlawful.

All data related to posted questions, answers, opinions and ratings will be stored until you request to have them deleted.

Help center – Zendesk

Our helpdesk is hosted by Zendesk. We offer you the opportunity to post questions, answers, opinions, and ratings on our helpdesk. If you make use of this opportunity, we will

  • process and publish your post
  • the date and time you submitted it
  • any pseudonym you may have used

When you visit the helpdesk, we store your IP-address.

All data related to posted questions, answers, opinions and ratings will be stored until you request to have them deleted. The data collected while visiting our helpdesk will be temporarily stored, but not in association with any other of your data. It serves for the purpose of analyzing, or improving the features of our helpdesk.

Contact – Zendesk and Hubspot

If you contact us via email, contact form, widget, phone or chatbot, the data you provide will be used for the purpose of processing your request and to answer your inquiry. For every contact we create a ticket that may contain the following information, depending on the way you got in touch with us and depending on the information your provided:

  • Phone number (if you call)
  • E-Mail address (if you write to us)
  • Name or alias (if you write to us)

For processing and replying to these tickets, we use the help desk Zendesk and the CRM Hubspot.

If you are no longer an active customer, we will automatically delete all conversation after 5 years. Of course, you can ask us to have tickets, conversations and user-accounts delete at any time. Your data is also processed by Zendesk and Hubspot. They use it for technical processing only and are not forwarding your data to a third party.Art. 6 Para. 1 lit. b) GDPR
Chatbot – Hubspot

Virtual Spirit always places a cookie in your browser.

If you communicate with us via our chatbot, the information and data you provide is forwarded to our CRM and helpdesk. The company operating the chatbot is VirtualSpirits. They will collect the following information: IP Address Device you accessed the chatbot from Data shared via the chatbot VirtualSpirits stores personal information on servers in Data centers within the European Union

Hubspot chatbot uses the for technical processing only and are not forwarding your data to a third party. You may revoke the data processing.

 
Google reCAPTCHA

Our website uses Google reCAPTCHA to check and prevent automated servers (“bots”) from accessing and interacting with our website. The following data is saved:

  • IP address from which input box has been used

Google may collect other information necessary to provide and guarantee this service

YouTube

YouTube will record and process at a minimum

  • your IP address
  • the date and time the video was displayed
  • the website you visited

A connection to the DoubleClick advertising network of Google is established. If you are logged in to YouTube when you access our site, YouTube will assign the connection information to your YouTube account. For the purpose of functionality and analysis of usage behavior, YouTube permanently stores cookies on your device via your browser.

To prevent YouTube from profiling your data, you must either log out of YouTube before visiting our site or make the appropriate settings in your YouTube account.

If you do not agree to YouTube’s cookie processing, you have the option of preventing the installation of cookies by making the appropriate settings in your browser. Newsletter – Hubspot

You register for the newsletter via a double-opt-in process. This means, after leaving your email address you need to confirm the registration with a link sent to your email address. For the registration we only save the following data:

We also store the IP address of your computer and the date and time of your registration. During the registration process, we will obtain your consent to receive this newsletter and the type of content it will offer, with reference made to this privacy policy.

  • No other purposes than sending newsletters
  • No forwarding to 3rd party with exception of hubspot

Hubspot is our service provider for sending automated emails like newsletters.

You can revoke the reception of the newsletter anytime.

Your data is also processed by Hubspot. They use it for technical processing only and are not forwarding your data to a third party.

Google AdWords with Conversion Tracking

Our website uses Google AdWords and conversion tracking.

If you click on an ad placed by Google, the conversion tracking we use stores a cookie on your device. If the cookie is still valid and you visit a specific page of our website, both we and Google can evaluate that you clicked on one of our ads placed on Google and that you were then forwarded to our website.

The data collected this way is in turn used by Google to provide us with an evaluation of visits to our website and what visitors do once there.
